Legal Counsel, Legal Grant Management Team - GL D - 5 years Defined Duration

Country team related:
• Under the supervision of the Manager, Legal Grant Management Team, the Legal Counsel provides legal advice and counsel to assigned country teams and/or relevant internal departments on matters relating to the management of Global Fund grant portfolios. Such matters include, but are not limited to: negotiation of grant agreements or other agreements related to Global Fund program implementation, legal risk identification and mitigation, issues of public international law, dispute resolution, internal policy development, internal governance matters, and ensuring the consistent application of, and compliance with, relevant legal and policy approaches of the Global Fund.

Non-country-team related:
• The Legal Counsel will also advise on other non-country-team specific matters (e.g., Board or Secretariat committees work, other institutional and governance matters), as assigned.

Key Responsibilities

Country team related:

To provide legal advice and counsel to assigned country teams in connection with:

  • Submission and review of funding requests, and grant negotiation and design;
  • Negotiating and drafting grant agreements and related legal documents;
  • Management of grant portfolios (including, but not limited to, interpretation and enforcement of grant agreements, procurement matters, program implementation, privileges and immunities, dispute resolution, recoveries, facilitating the assurance work of the Office of the Inspector General, and ensuring consistency and compliance with Global Fund policies and procedures); and
  • Risk identification and mitigation. .

Non-country-team related:

Depending on the Legal Counsel’s experience and skill-set,

  • To provide legal advice and counsel on the development of Global Fund policies, procedures and guidance relating to grant management;
  • To provide advice and legal support to governance bodies, including the Board and its committees, and Secretariat committees; and
  • To provide advice and legal support to other departments/teams (e.g., Finance, Risk, Access to Funding, Sourcing, Policy Hub, Operational Policy Hub).

Subject to change by the Executive Director at any time at their sole discretion.

Qualifications

Required:

  • Law degree.

Desirable:

  • Post-graduate degree in banking/financial law and/or international law.
  • Bar membership.

Experience

Required:

  • Legal experience with international organizations, particularly in the areas of governance and policy development;

Desirable:

  • At least 7 years of relevant professional legal experience.
  • Practical work experience in both civil law and common law jurisdictions;
  • Cross-border transactional experience in commercial, (international) banking, project finance, and corporate law, including governance, institutional and administrative policies, dispute resolution; and
  • Understanding of international financial law and/or public international law.

Competencies

Languages:

An excellent knowledge of English and preferably a good working knowledge of French or one of the following: Arabic, Russian, and Spanish. Knowledge of other languages would be an asset.
